The laws and working in a nursing home.?

i am training to be a cena in my local community college, the class teaches a great deal about abuse, neglect, and violating rights of nursing home residents. I have no problem with all of the laws and protecting the residents rights. I know that being a cena i have to protect these people from nelglect, abuse, from harm, and take care of them. My question is should us as cena's get into trouble for neglect or abuse if the problem is past our control ? My friend worked at a nursing home, the lift that they had was broken, everyone reported to be fixed and no one fixed it. With it being the only lifted that they had someone used it not knowing it was broke, and one of the residents got hurt. Know the cena is being investegated for abuse. The cena that used the lift just came back from medical leaving not knowing the lift was broke. There was no sign or nothing put on the lift saying broken. Who should be held liable the cena or the nursing home. I don't want to come across this problem.
